Current abortion language in Missouri Constitution
Two difference in the 2024 pro-abortion changes and the 2026 proposed Amendment 3;
Parental consent for minors
2024
There is no informed consent of the parents of minors seeking an abortion. Also, the abortionist cannot be sued for negligence.
2026
The proposal requires informed and voluntary consent, including parental or judicial consent for minors, subject to the constitutional provisions and laws implementing them.
The General Assembly may also enact laws providing a minor's ability to consent to an abortion through a court order.
Gender-transition procedures for minors
The 2026 proposal says:
No gender transition surgeries shall knowingly be performed on children under 18.
It also prohibits knowingly prescribing or administering:
- cross-sex hormones
- puberty-blocking drugs
to children under 18 for the purpose of gender transition.
There are exceptions for things such as medically verifiable disorders of sex development and treatment of unrelated infections, injuries, diseases or disorders.
Several minors in foster care have received transition surgeries under the CURRENT Constitution. Since they are in foster care, the state (taxpayers) have paid for these transitions.
Amendment 6 is under review with the SCOTUS. AG Catherine Hanaway is seeking emergency relief since the Missouri Supreme Court overturned.
IF Amendment 6 is on the ballot and the Proposed Amendment 3 FAILS this November, abortion will FOREVER be in the Missouri Constitution.
